I. Die Rechtsphilosophie als Zweig der Philosophie. 1. Vom Wesen
der Philosophie. a) Die Philosophie ist sich selbst problematisch.
Wahrend andere Wissen schaften sich von der Vorfrage, was ihr
Gegenstand und ihre Aufgabe ist, 10slOsen 1 konnen, gehort die
Frage nach dem Wesen der Philosophie ) schon in die Philo sophie
hinein. Jeder Philosoph namlich bestimmt, wenn er ein originaler
Denker ist, "nicht nur, was er antworten, sondern auch, was er
fragen will" (SIMMEL a. a. O. S. 10), und versucht aus dieser
Berichtigung und Vertiefung der Problemstellung neue Einsichten und
gelauterte Ergebnisse zu gewinnen. Deswegen mussen wie in der
Vergangenheit, so in aller Zukunft viele Systeme, mebrere Aufgaben,
allerlei Zweige, nicht wenige Richtungen und Schulen nebeneinander
stehen, die samt und sonders den gleichen Anspruch haben, als
Philosophie zu gelten. Was ihnen ge meinsam ist, kann mit einem
Worte gesagt werden, wenn man sich nicht scheut, ein der AnmaBung
verdachtiges und etwas auBer Mode gekommenes zu gebrauchen:
Philosophie ist Weisheit. Was aber Weisheit ist, bringt uns
FRIEDRICH RUCKERT in den ersten Zeilen seiner " Weisheit des
Brahmanen" nahe: "Ein indischer Brahman, geboren auf der Flur, Der
nichts gelesen als das Weda der Natur; Hat viel gesehn, gedacht,
noch mebr geahnt, gefuhlt, Und mit Betrachtungen die Leidenschaft
gekiihlt; Spricht bald was klar ihm ward, bald um sich's klar zu
machen, Von ihn angehnden halb, halb nicht angehnden Sachen. Er hat
die Eigenheit, nur Einzelnes zu sehn, Doch alles Einzelne als
Ganzes Zll verstehn."
